北京大学国际法学院

【简介】北京大学国际法学院（School of Transnational Law at Peking University，英文缩写STL）成立于2007年7月。致力于培养顺应全球化发展需要，具有独立从事涉外经济法律实务工作能力的应用型高级法律人才。美国著名法学家雷蒙教授(Jeffrey S. Lehman)担任创院院长。雷蒙教授曾任美国密歇根大学法学院院长、美国法学院院长联合会主席以及美国康奈尔大学校长[1]。

【北京大学国际法学院的J.D模式】北京大学国际法学院是中国大陆600多所法学院中第一所按照法律博士，即 J.D模式（中文叫法律硕士）培养学生的法学院。课程设置基本上参照美国法学院的设置。

为什么此时北大创建这样一个项目？因为过去的十年间，全球化的进程已经产生的新一代的律师职业。律师的客户都是在进行全球性商业活动，律师因此必须与之相适应。为了适应这样的要求，许多亚洲和欧洲国家已经可是创立JD教育模式。和其他的教育模式不同，JD模式最注重培养学生掌握学术技能，而不是掌握某一项具体的知识。这种学术技能包括全面看问题的能力、联系法律规则和相应的价值政策的能力、辨别法律因时而变的路径的能力、以及融合不同权威来源且相互冲突的法律原则的能力。学生必须能够用流利的英语展示这些能力，因为英语是国际法律实践的主要语言。

同时，JD项目的学生还应当掌握特定领域的法律原则。STL将重点关注那些对中国国际业务最有影响的法律原则，同时也会关注起源于普通法系的一些法律原则。

为了培养学生掌握这些技能，这些项目广泛的采用苏格拉底式教学法。同时还会用法律诊所式课程、论文写作以及丰富的法律实践课程来补充这个教学法（比如高强度的法律调研、法律写作和法律英语）。

STL聘请了Jeffrey S. Lehman教授作为创院院长。Lehman院长是公认的世界最顶级的法律教育专家之一。他是美国康奈尔大学法学教授，曾任美国康奈尔大学校长。他还曾经是美国密歇根大学法学院院长，美国法学院院长协会主席。他曾经荣获北京大学的荣誉博士学位，也是中国若干所大学的荣誉教授[2]。

【国际法学院的国际化体现】Transnational 这个词指的是能跨越国境的事物，也是能超越国境的事物。国际法学院的国际化有很多方面的表现。

在我们的日常生活中，我们绝大多数的行为都只是受到一个国家法律包括其部门法律的规制。但是今天，越来越多的行为受到本国法律以外的法律的规制：外国法、本国与外国的协议、地区和国际组织的规章。这一点在商业交易中尤其明显，尽管在其他领域也是如此。STL在强化学习国际法律、学习这些法律如何运行以及律师如何运用这些法律方面将是独一无二的。

国际法律日渐重要，并且促进了国际法律职业的发展。律师因此需要培养在国际法律方面的特长。国际律师的日常工作重点就是受国际法律规制的交易和争议。

以培养学生适应国际法律职业为目标，STL提供研究生阶段的法律教育，我们的学生会获得英文的法律博士（JD）学位和中文的法律硕士学位。通过学习，我们希望学生能够掌握由国际法律职业人共享的一系列的学术技能、专业知识和职业道德规范。为了与国际法律职业的通常实践保持一致，STL的教学都是用英语进行（有关中国法的部分除外）。

学生需要掌握的最基本的技能既有理论上的也有实践上的。理论层面上，学生必须能熟练的掌握法律思维，具体包括演绎推理、归纳推理和类比推理。学生必须展示有智慧的批判精神，负有同情心的应对意见相左的观点。另外，法律调查影响到世界各地不同的法律体系，学生必须熟悉法律调查的技能，必须掌握法律写作技能（包括分析性的和论证性的），必须熟练应用法律英语。

学生需要掌握的最基本知识包括普通法系和大陆法系中核心法律领域的核心概念，包括公法和私法上的最基本原则。另外，还包括多种法律制度在国际领域的相互影响方式，以及公民个体和国家如何在这些制度体系中找到正确的方向。

职业责任的基本原则要求学生理解道德、职业和法律原则是如何塑造律师与（a）客户的关系，律师与（b）其他法律参与人，包括其他律师、法官和政府官员的关系。

第一学年必修法律实践项目

第一学年，所有学生必须参见法律实践项目。法律实践项目是专向针对职业技能的训练项目。通过这一项目，学生需要用英文掌握法律调查、法律写作和法律代理。法律实践项目将由部分教授负责完成，同时四个母语为英语的教学助理从旁协助。

第一学年必修职业责任项目

在第六个为期六周的模块中，学生应当必修“在社会和历史中的律师”课程。该课程将从比较法的角度介绍职业责任的最基本问题。课程重点将会关注律师在不同社会中的角色、责任和职业生涯的相同与不同之处。

高年级法律实践项目

在第二年和第三年，所有的学生必须参加高年级法律实践项目。该项目会提供法律写作和代理方面的进一步培训。该项目会介绍律师作为问题解决者和谈判者的角色。高年级法律实践项目的核心要素在于涵盖“诊所式”经历，也就是学生应当在实际代理案件中体会法律实践的职业和道德挑战。

【师资队伍】Hai Wenis Vice President of Peking University with responsibility for the Shenzhen Campus; Professor of Economics; and Deputy Director of the China Center for Economics Research. He studied at Peking University and he holds a Ph.D. from the University of California at Davis. He has also taught at the California State University, the University of California at Davis, the Colorado State University, and the Australian National University. He is a scholar of international economics and development economics, and he is the author ofInternational Trade – Theory, Policy, and Empirical Issues. He is responsible for, several years ago, creating on the Shenzhen campus an innovative, English-language program of graduate business education. He conceived the idea of having Peking University launch China’s first true J.D. program, and he recruited Professor Lehman to lead it.

海闻教授是北京大学副校长，北大深圳研究生院院长，经济学教授，中国经济研究中心副主任。他曾就读于北京大学，获得加利福尼亚大学戴维斯分校的经济学博士学位。他曾任教于加利福尼亚州立大学，加利福尼亚大学戴维斯分校，科罗拉多州立大学和澳大利亚国立大学。他的主要研究领域为国际经济学和发展经济学。主要著作有：《国际贸易：理论、政策、实践》。几年前，他负责在北大深圳研究生院创立了极具创新性，并全英文授课的商学院。她第一个想到了在北京大学创立中国第一个J.D.项目，并且聘请Lehman教授将这一想法付诸实践。

Jeffrey Lehmanis Professor of Law and Former President of Cornell University; President of the Institute for China-U.S. Law & Policy Studies; and Chancellor and Founding Dean of the Peking University School of Transnational Law. He studied at Cornell University and the University of Michigan Institute of Public Policy Studies, and he holds a Juris Doctor degree from the University of Michigan Law School. He has served as Dean of the University of Michigan Law School, Law Clerk to U.S. Supreme Court Justice John Paul Stevens, and President of the American Law Deans Association. He has also taught at the Yale Law School, the University of Paris II, and Tsinghua University. He is a scholar of tax law and public benefits law, and he is the author ofCorporate Income Taxation.

Stephen Yandleis Associate Dean of the Peking University School of Transnational Law. He holds a bachelors degree and a Juris Doctor degree from the University of Virginia. He has served as Assistant Dean at the University of Virginia, as Associate Dean at the Northwestern University Law School, as Associate Dean of the Yale Law School, as Deputy Consultant on Legal Education and Admission to the Bar of the American Bar Association, and as Vice President for Global Law School Programs at LexisNexis. He has also served as Chairperson of the Section on Administration of Law Schools of the Association of American Law Schools (“AALS”), President of the National Association for Law Placement, and member of the AALS Committee on Legal Education Exchange with China. At the Yale Law School he taught about diversity in higher education.

Liya Rongis Professor of Law and Assistant Dean at the Peking University School of Transnational Law. She studied at the China University of Political Sciences and Law, the Harvard Law School, and the John F. Kennedy School of Government, and she holds an S.J.D. degree from the University of Michigan Law School. She has served as Publisher of the Harvard China Review. She has also taught courses at the University of Michigan Law School, Peking University, the Beijing National Accounting Institute, and Tsinghua University. She is a scholar of corporate tax law and international tax law, and she is the author ofTax Competition in Developed and Developing Countries: The Case of China.

荣丽亚教授是法学教授和北京大学国际法学院副院长。她曾就读于中国政法大学，哈佛大学法学院和肯尼迪政府管理学院。她获得了密歇根大学法学院的法学博士学位。她曾是《哈佛中国评论》的出版人。她曾任教于密歇根大学法学院、北京大学、北京国家会计学院和清华大学。她是企业税法和国际税法专家，著有：《发达国家与发展中国家的税收竞争，以中国为例》。

Gary Bornis Visiting Professor of Law at the Peking University School of Transnational Law (in 2009-10), and a partner in the transnational law firm of Wilmer Cutler Pickering Hale and Dorr LLP. He studied at Haverford College, and he holds a Juris Doctor degree from the University of Pennsylvania Law School. He has served as Law Clerk to U.S. Court of Appeals Judge Henry Friendly and U.S. Supreme Court Justice William H. Rehnquist, and as member of the Executive Council of the American Society of International Law. He has also taught law at the St. Gallen University, Stanford University, University College London, University of Arizona, Georgetown University, and the University of Virginia. He is widely regarded as one of the world's pre-eminent authorities and practitioners in the fields of international arbitration and international litigation, and he is the author of several leading treatises, includingInternational Commercial Arbitration(3rd ed. Kluwer) andInternational Civil Litigation in United States Courts(4th ed. Aspen).

Howard Brombergis Visiting Professor of Law in the Legal Practice Program at the Peking University School of Transnational Law, Director of the S.T.L. Summer Training Institute in Legal Research and Writing, and Clinical Assistant Professor of Law at the University of Michigan Law School. He studied at Harvard College and Stanford Law School, and he holds a Juris Doctor from Harvard Law School. Professor Bromberg has served as Associate Director of the First-Year Lawyering Program at Harvard Law School and as Assistant Dean of Clinical and Professional Skills Programs at the Ave Maria School of Law. He has also taught at the University of Chicago Law School and the Stanford Law School. He is a scholar of property law and American legal history.

Anne Burris Visiting Assistant Professor of Law in the Legal Practice Program at the Peking University School of Transnational Law, and Director of Legal Writing at the Wayne State University School of Law. She studied at the Oakland University and the Wayne State University graduate school, and she holds a Juris Doctor degree from the Wayne State University School of Law. She has served as a Law Clerk in the Federal District Court, the Federal Bankruptcy Court, and the Michigan Court of Appeals. An expert in dispute resolution and corporate law, she has been a partner in the law firm of Dykema Gossett, LLC, senior counsel to Allied Domecq, PLC, and she has taught research, writing, and advocacy at the Detroit College of Law and the Ave Maria School of Law.

Jason Eysteris Visiting Assistant Professor of Law in the Legal Practice Program at the Peking University School of Transnational Law. He studied at Princeton University and he holds a Juris Doctor degree from the Fordham Law School, where he served as Assistant Editor of the Journal Art and the Law. An expert in immigration law and arts law, he has worked for Actor’s Equity Association and for Ars Musica, served as Senior Editor of the Immigration and Nationality Law Handbook, served as Executive Director of the Princeton in Asia Foundation and for the University of Michigan’s Southeast Asia Business Program. He has also been a partner in an immigration law firm, and he has taught legal research and writing and clinical law at the Ave Maria School of Law.

James Feinermanis Senior Academic Advisor to the Dean of the Peking University School of Transnational Law, and James M. Morita Professor of Asian Legal Studies at the Georgetown University Law Center. He studied at Yale University and he holds a Juris Doctor degree from Harvard Law School. He has been a Fulbright Lecturer at Peking University and has received fellowships from the MacArthur Foundation and the Woodrow Wilson International Center for Scholars. He is a scholar of corporate law, corporate finance, and international and comparative law, with a particular focus on the legal systems of China, Japan, and Asia more generally.

James Feinerman教授是北京大学国际法学院院长的高级学术顾问，是乔治城大学法律中心亚洲法律项目的James M.Morita教授。他曾就读于耶鲁大学，在哈佛大学法学院获得法律博士学位。Feinerman教授是北京大学的Fulbright学者并获得麦克阿瑟基金会和伍德罗·威尔逊国际中心的学术奖金。他是公司法、公司财务、国际法与比较法专家，其中研究的重点领域是中国、日本与一般意义上的亚洲法律体系。

Whitmore Grayis Visiting Professor of Law at the Peking University School of Transnational Law, and Professor Emeritus at the University of Michigan Law School. He studied at Principia College and holds a Juris Doctor degree from the University of Michigan Law School and an LLD from Adrian College. He has served as a consultant on law reform in Indonesia, Cambodia, and Argentina and has been a visiting scholar at Tokyo University. He has also taught at Fordham University, Jilin University and the Academy Summer Program. He is a scholar of contract law, commercial law, and comparative legal systems, and he translated into English the Russian Civil Code and the Chinese Civil Law Principles Civil Code.

Whitmore Gray教授是北京大学国际法学院的访问教授，是密歇根大学法学院的荣誉退休教授。他曾就读于Principia学院，他获得了密歇根大学法学院的法律博士学位和Adrian学院的法学博士学位。他曾作为印度尼西亚、柬埔寨和阿根廷的法律改革顾问并且一直是东京大学的访问学者。他在Fordham大学、吉林大学和暑期项目学校任教。他是合同法、商法和比较法律制度的专家。他曾将《俄国民法典》和中国的《民法通则》翻译成英文。

Thomas Kauperis Visiting Professor of Law at the Peking University School of Transnational Law, and Professor Emeritus at the University of Michigan Law School. He holds a bachelors degree and a Juris Doctor degree from the University of Michigan Law School. He has served as Law Clerk to U.S. Supreme Court Justice Potter Stewart, and as Deputy Assistant Attorney General of the United States, and as Assistant Attorney General of the United States in charge of the Antitrust Division of the Department of Justice. He has also taught at the Harvard Law School. He is a scholar of property and antitrust law, and he is the author ofProperty: An Introduction to the Concept and the Institution.

Thomas Kauper是北京大学国际法学院的法学访问教授，密歇根大学法学院的荣誉教授。他拥有密歇根大学法学院的学士学位和法律博士学位。他曾任美国最高法院Potter Stewart法官的法律秘书，美国第一副助理总检察长，美国司法部掌管反垄断司的助理总检察长。Kauper教授曾任教于哈佛大学法学院。他是物权和反垄断法的专家，著有《物权：原理与制度概论》。

Peter Malanczukis C.V. Starr Professor of Law at the Peking University School of Transnational Law. He studied at the University of Göttingen, the University of München, and the University of Heidelberg, and he holds a Doctor of Law from the University of Gliessen. Professor Malanczuk has served as the Dean of the City University of Hong Kong School of Law and as the Department Head of International Law at the University of Amsterdam and the Erasmus University. He has also taught at the University of Michigan, the University of California at Berkeley, the University of Addis Ababa, Peking University, Tsinghua University, and the University of Hong Kong. He is a scholar of international law and arbitration law, and he is the author ofAkehurst’s Modern Introduction toInternational Law.

Peter Malanczuk教授是北京大学国际法学院的C.V.Starr教授。他曾就读于哥廷根大学，慕尼黑大学和海德堡大学，获得了及森大学的法律博士学位。Malanczuk教授曾任香港城市大学法学院的院长，阿姆斯特丹大学和伊拉斯慕斯大学国际法学院的系主任。他还曾任教于密歇根大学、加州大学伯克利分校、亚的斯亚贝巴大学、北京大学、清华大学和香港大学。Malanczuk教授是国际法和仲裁法专家，他著有《Akehurst的现代国际法概论》。

Randall Peerenboomis Visiting Professor of Law at the Peking University School of Transnational Law, Professor of Law at La Trobe University in Australia, Associate Fellow at the Oxford University Centre for Socio-Legal Studies, and Director of the Oxford Foundation for Law, Justice and Society China Rule of Law Programme. He studied at the University of Wisconsin and holds a Ph.D. from the University of Hawaii and a Juris Doctor degree from Columbia University. He has served as an advisor to the Asia Development Bank and the Ford Foundation. He has also taught at the UCLA Law School. He is a scholar of legal theory, comparative law, law and development, and international business transactions. He is the author ofChina ModernizesandChina's Long March toward Rule of Law.

Randall Peerenboom是北京大学国际法学院的法学访问教授，澳大利亚拉筹伯大学的法学教授，牛津大学社会法律研究中心助理，牛津大学基金会中国法治的法律、司法及社会项目主任。他就读于威斯康辛大学，拥有夏威夷大学的哲学博士学位和哥伦比亚大学的法律博士学位。Peerenboom教授曾任亚洲发展银行与福特基金会顾问。他曾任教于加利福尼亚大学洛杉矶分校法学院。他是法理学、比较法、法律与发展和国际商事交易的专家。著有：《中国的现代化与中国法治的长征》。

Thomas Weidenbachis Visiting Lecturer in the Legal Practice Program at the Peking University School of Transnational Law. He studied at the University of Chicago and at Oxford University, and he holds a Juris Doctor degree from the University of California, Los Angeles. He has practiced law in California, and he has served as an advisor to several private law firms and one state-owned enterprise in China. He has also taught at the Washtenaw Community College, the University of Michigan-Dearborn, and the China University of Politics and Law.

Thomsa Weidenbach是北京大学国际法学院法律实践项目的访问学者。他曾就读芝加哥大学和牛津大学。他拥有美国加州大学洛杉矶分校的法律博士学位。他在加州职业，是若干律师事务所的顾问，并担任一家中国国企的顾问。他曾任教与Washtenaw社区学院、密歇根Dearborn大学和中国政法大学。

Frank Wuis Visiting Professor of Law at the Peking University School of Transnational Law, and Professor of Law at the Wayne State University School of Law. He studied at the Johns Hopkins University, and he holds a Juris Doctor degree from the University of Michigan. He has served as the Dean of the Wayne State University School of Law, a law clerk in the Federal District Court, and as a trustee of Gallaudet University, and he is a member of the Committee of 100. He has also taught at Howard University, the University of Michigan, and Columbia University. He is a scholar of professional responsibility and discrimination law, and he is the author ofYellow: Race in America Beyond Black and White.

Frank Wu是北京大学国际法学院的访问教授，是Wayne州立大学法学院法学教授。他曾就读于约翰霍普金斯大学，拥有密歇根大学法律博士学位。他是Wayne州立大学法学院院长，联邦地区法院的法律秘书，Gallaudet大学的校董，100委员会的成员。他曾在哈佛大学、密歇根大学和哥伦比亚大学任教。他是执业责任和歧视法方面的专家，著有：《黄皮肤:美国黑人和白人以外的种族》。[4]
